1. Introduction

Welcome to TutorKids.co.uk ("Platform"). These Terms of Service govern your access to and use of our Platform and services. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our Platform.

2. Definitions

• "Platform" refers to TutorKids.co.uk, including its subdomains and related services.
• "User" refers to any individual using the Platform, including Parents, Tutors, and Students.
• "Parent" refers to an individual who registers to find tutoring services for a student.
• "Tutor" refers to an individual who registers to offer tutoring services.
• "Student" refers to the recipient of tutoring services, typically a minor under the supervision of a Parent.

3. Eligibility

• Parents and Tutors: Must be at least 18 years old and capable of entering into a legally binding agreement.
• Students: Typically minors; use of the Platform for Students under 13 requires parental consent in compliance with the Children's Online Privacy Protection Act (COPPA). 

4. Account Registration

• Information Accuracy: Users must provide accurate and complete information during registration and maintain the accuracy of such information.
• Account Security: Users are responsible for maintaining the confidentiality of their account credentials and for all activities under their account.

5. Services

• Platform Role: TutorKids.co.uk facilitates connections between Parents and Tutors. We do not employ Tutors nor are we responsible for the services they provide.
• User Responsibilities: 
• Parents: Ensure that tutoring sessions are appropriate and that the student’s participation is supervised as necessary.
• Tutors: Provide tutoring services in accordance with applicable laws, maintain necessary qualifications, and adhere to our safeguarding policies.

6. Code of Conduct

• Respectful Interaction: Users must interact respectfully and professionally.
• Prohibited Conduct: Users shall not engage in harassment, discrimination, or any illegal activities on the Platform.

7. Safeguarding and Student Protection

• Tutor Requirements: Tutors must undergo regular background checks (e.g., DBS checks) and complete safeguarding training to ensure a safe learning environment. 
• Reporting Concerns: Any concerns about a student’s safety or well-being must be reported immediately to the appropriate authorities and to TutorKids.co.uk.

8. Payment Terms

• Fees: Parents agree to pay fees as specified at the time of booking. Tutors agree to the commission structure outlined upon registration.
• Payment Processing: Payments are processed through secure third-party payment gateways. TutorKids.co.uk is not responsible for payment disputes arising from third-party services.

9. Cancellations and Refunds

• Cancellation Policy: Cancellations of classes must be made in 24hours before specified time of booking.
• Refunds: Refunds eligibility and processing are subject to our confirmed defaults, which will be covered by equivalent lesson voucher on the Platform.

Minimum Accepted Enrollments: All students are allowed to have 4 MINIMUM class bookings per month, in order to remain on the platform.

10. Intellectual Property

• Ownership: TutorKids.co.uk owns all rights to the Platform's content, excluding User-generated content.
• User Content: By posting content on the Platform, Users grant TutorKids.co.uk a non-exclusive, royalty-free license to use, reproduce, and distribute such content.

11. Privacy

• Data Collection: We collect and process personal data in accordance with our Privacy Policy.
• Student Privacy: Special care is taken to protect the privacy of Students, especially minors, in compliance with applicable laws and regulations. 

12. Disclaimers and Limitation of Liability

• No Warranty: TutorKids.co.uk provides the Platform "as is" without warranties of any kind.
• Limitation of Liability: TutorKids.co.uk shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Platform.

13. Indemnification

Users agree to indemnify and hold TutorKids.co.uk harmless from any claims arising out of their use of the Platform or violation of these Terms.

14. Termination

TutorKids.co.uk reserves the right to suspend or terminate User accounts for violations of these Terms or any applicable laws.

15. Changes to Terms

We may update these Terms from time to time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom.
